SirEnergies tells you about REMIT, the regulation that provides a European regulatory framework specific to wholesale market in order to improve their functioning, to prevent abuse and, where appropriate, to punish.
In this article, we describe how ACER implemented this regulation in practice, in consultation with national regulators, trading and information platforms and all actors in the sector: GRTs, market participants, exchanges, etc.
Finally, to allow you to get a concrete idea of the abuses that REMIT is trying to eradicate, we briefly present five practices that have led to sanctions.
On 24 June 2022, the Council of State confirmed the first sanction of the CoRDiS (Committee for the Settlement of Disputes and Sanctions) for manipulating wholesale energy markets under the European REMIT regulation.
Following an investigation opened in 2014, the CRE (Commission de Régulation de l'Énergie) sanctioned the company VITOL S.A. in October 2018 for manipulating the gas market in PEG Sud, in violation of article 5 of the REMIT regulation, which prohibits this type of practice.
In France, the national energy regulatory agency is CRE, Commission for Energy Regulation.
To date, the CRE, as part of its powers to supervise wholesale markets, has issued two sanctions decisions against players in the energy market: a €5 million fine on 5 October 2018 against VITOL S.A., which lost its appeal before the Council of State, and a €1 million fine on 19 December 2019 against BP Gas Marketing Limited, which can still appeal.
As the CRE states in its report on the surveillance of wholesale markets for the year 2020, its activity as part of its supervisory mission is consistent and involves a large number of actors and actions:

REMIT is a European regulation relating to Integrity And at the transparency wholesale energy markets (EU regulation no. 1227/2011 of 25 October 2011). It is directly applicable in all Member States of the European Union and was put in place by ACER.
REMIT fills important gaps that existed in European and national competition laws through Article 102 of the Lisbon Treaty, which focuses primarily on abuses that harm consumers and abuses that harm competition between actors, in particular the abuse of a dominant position.
To fully understand what REMIT is, the best thing is to listen to what the 1st director of ACER, Alberto Pototschnig, said about it. In December 2012, he was interviewed by the Florence School of Regulation on the” new REMIT regulation ”. In summary, he says that REMIT:
“was created to combat insider trading and other market abuses; while national authorities have enforcement and investigative powers, the task of detecting abuses at European level falls to ACER.”
With REMIT, the European Parliament wanted to provide the energy sector with a specific regulatory framework to detect and deter market abuse And the Insider trading on European energy markets:

Through these objectives, REMIT plays an essential role in completing the European internal energy market and in promoting integrity.
According to ACER, all players in the energy market (Energy Market) must be able to benefit from REMIT; that is why ACER is trying to provide everyone with as much added value as possible at the lowest cost by relying as much as possible on existing reporting channels, such as trading platforms, exchanges and information platforms on the transparency of the wholesale energy market.
With REMIT, ACER wants end consumers to benefit from better prices, not necessarily lower prices, but prices that better reflect market fundamentals.
The Agency for the Cooperation of Energy Regulators, known as ACER, is a European Union agency created in 2010 which ensures the coordination national energy regulatory agencies on cross-border issues. ACER aims to help national regulatory authorities in the field of energy and market opening to exercise and coordinate their regulatory tasks at Community level.
Within the framework of REMIT, ACER's main role is to detect any abuse on the European energy market. Its task is all the more complex as this market increasingly favors cross-border trade. This is why ACER created an information platform, ARIS, to collect and analyze transactions.

Since the creation of the REMIT regulation, the total amount of fines has risen to just over €90m for 18 sanctions, including 1 in 2015, 5 in 2018, 5 in 2019, 3 in 2020 and 4 in 2021.
However, it should be noted that the number of sanctions taken against market players since the creation of REMIT is quite low, compared to the number of surveys and data analyzed.
During the ACER Forum on the transparency and integrity of energy markets, the implementation of REMIT was described as a success by all players in the energy sector.
The expected improvements now focus on optimizing the processes described in the European legislative and regulatory framework, and on improving cooperation with the various market segments, in order to improve their supervision.
